Sex offender back in Prescott on probation violation

PRESCOTT - Jonathan Joseph Bodary, convicted of child sex charges in 1999, and who now is accused of downloading pornography in violation of the terms of his probation, has been brought back to Arizona after being picked up on a warrant in Michigan.

Bodary, 43, was once a teacher and assistant coach at Bradshaw Mountain High School, and his conviction resulted from sexual conduct with three BMHS students, 14 to 17 years old, in 1995 and 1996. Facing the possibility of 129 years in prison if a jury found him guilty, Bodary agreed to plead guilty to attempted child molestation, sexual abuse, and contributing to the delinquency of a minor. In January 1999 was sentenced to prison for 10 years, followed by lifetime sex offender probation.

Bodary appealed, saying his attorney was ineffective during sentencing. In February 2000, he was re-sentenced and served eight years before beginning a term of lifetime probation.

But Bodary's adult probation officer in Michigan, where had he been living, reported that he had downloaded more than 1,000 pornographic images, which authorities allege they found on his computer. That would violate one of the terms of his sex offender probation, mandating that he could "not utilize the Internet for any matters related to sex."

On Monday, Bodary appeared before Yavapai County Superior Court Judge Cele Hancock for an arraignment on the petition to revoke his probation.

He denied the charge, which is essentially the same as pleading "not guilty."

Hancock set his next appearance for late January.

Bodary is being held in the county jail on a $25,000 bond.
